Terms and Conditions

WORKPLACE WELLBEING SURVEY PRIZE DRAW 2024 TERMS AND CONDITIONS

Workplace Wellbeing Survey powered by the EMA & nib – prize draw worth over $22,000 inclusive of GST.

1. This competition is open to people who complete the EMA and nib Workplace Wellbeing Survey 2024 between Wednesday 1 May 2024 – Wednesday 22 May 2024 at 5.00 pm and enter their details to go in the draw for a chance to win a prize. Individuals can only enter the draw once, however multiple entries can be submitted from the same company. To be eligible to win a prize, an entrant must also be a New Zealand resident aged 18 years old or older.

2. The prize pool comprises of the following individual items:

Two programme registrations for the EMA’s Stress Management and Mental Resilience workshop valued at $1,541.00 inclusive of GST. This is a Learning course delivered by EMA.
One Apple Watch series 9 (GPS only) valued at $749.00 inclusive of GST.
Ten Rebel Sport vouchers valued at $200.00 inclusive of GST each.
Ten My Food Bag vouchers valued at $200.00 inclusive of GST each.
Fifteen Bonfire Cards valued at $200.00 inclusive of GST each.
Three Assessing your Strengths, Interests and Values, e-learning registrations valued at $86.25 each inclusive of GST. This is a Learning course delivered by EMA .
Three Resiliency Bundle e-learning registrations valued at $253.00 each inclusive of GST. This is a Learning course delivered by EMA .
One Workplace Resilience Package: Sauna, Ice Plunge and Resilience Package valued at $6,894.25 inclusive of GST. This is a package delivered by The Sauna Collective and The Awareness Academy.
One Mental Health and Resilience Workshop, valued at $3,450.00 inclusive of GST. This is a workshop delivered by The Awareness Academy.

3. The winner of each prize will be selected at random with one person winning one individual prize. Where there is more than one of a particular prize (i.e. there are ten Rebel Sports vouchers in the prize pool) a winner will win one of the Rebel Sport vouchers, not all ten of them. The draw will be done by EMA and nib on Wednesday 29 May 2024 and each winner will be contacted by email and/or phone by Wednesday 5 June 2024. If a winner cannot be contacted or does not respond within 5 business days of attempted notification, the prize(s) will be forfeited and awarded to an alternate winner drawn from the remaining entries of the prize draw at the EMA and nib’s sole discretion. EMA and nib’s decision is final, and no correspondence will be entered into.

4. No entry or completed survey can win more than one individual prize.

5. For the EMA Learning course prizes, these will be awarded to individual winners. Each learning course will be conducted at a date that is agreed between the winner and EMA. Courses only apply to new bookings. For the avoidance of “doubt, “new bookings” in this context means a person who has not previously booked and successfully completed an EMA Learning course listed in clause 2 above. Registration for each of these courses will require a winner to follow the standard registration process and agree to the relevant terms and conditions available at https://www.ema.co.nz/Ema/ema/Terms-Conditions.aspx. All quoted values are at the EMA member rate. Where a winner is not an existing and active member of the EMA, they are entitled to the single registration for no additional cost. Where a prize is a digital programme, in order to redeem a prize, a winner must set up an account and agree to the terms set out in the use of EMA’s Learning Management System. 6. The winner of the Apple Watch series 9 (GPS only) will receive their watch by courier from nib. Apple is not associated with this promotion and has no responsibility to entrants of this competition. Neither nib nor EMA accepts any responsibility if, in the unfortunate case, the watch is lost or stolen in transit.

7. The winner of each Rebel Sport voucher will receive their voucher electronically by email. Each winner will have to agree to the terms and conditions of Rebel Sport. Rebel Sport is not associated with this promotion and has no responsibility to entrants of this competition. Neither nib nor EMA accepts responsibility for the redemption of a Rebel Sport voucher or if a Rebel Sport voucher is lost or stolen.

8. The winner of each My Food Bag voucher will receive their voucher electronically by email. Each winner will have to agree to the terms and conditions of My Food Bag. My Food Bag is not associated with this promotion and has no responsibility to entrants of this competition. Neither nib nor EMA accept responsibility for the redemption of a My Food Bag voucher or if a My Food Bag voucher is lost or stolen.

9. The winner of each Bonfire Card will receive their card by courier from nib. Each winner will have to agree to terms and conditions of Card Works Limited. Card Works Limited is not associated with this promotion and has no responsibility to entrants of this competition. Neither nib, nor EMA accept responsibility for the redemption of a Bonfire Card or if a Bonfire Card is lost or stolen .

10. For prizes provided by The Sauna Collective and/or The Awareness Academy these will be awarded to individual winners. These prizes will be conducted at dates that are agreed between each winner and The Sauna Collective and/or The Awareness Academy. Each winner will have to agree to terms and conditions of The Sauna Collective and/or The Awareness Academy whose terms and conditions are set out in clause 21 below. Neither nib, nor EMA accept responsibility for the redemption of a prize with The Sauna Collective and/or The Awareness Academy.

11. Any costs or other expenses incurred in relation to accepting or using a prize including but not limited to accommodation and travel are the responsibility of each winner.

12. If we cannot provide a prize that is part of the prize pool as reasonably anticipated due to any reason beyond nib and the EMA’s reasonable control, we reserve the right at our sole discretion to provide a substitute prize of similar value or specification.

13. Prizes cannot be transferred or exchanged for cash or a refund.

14. We reserve the right to require any winner to provide proof of identity and/or proof of compliance with these terms and conditions.

15. To the maximum extent permitted by law, neither nib nor EMA (including our officers, employees, and agents) will be liable to a winner or (even if we are negligent) for any loss or damage (whether direct, indirect, special or consequential, or otherwise), injury or disappointment which any person suffers or sustains in connection with the competition, including as a result of the conduct of any third party supplier or otherwise as a result of a prize winner accepting or using a prize. Nothing in this clause limits any entrants rights (if any) under the Consumer Guarantees Act 1993.

16. To the maximum extent permitted by law, nib and the EMA is not responsible for any error, omission, interruption, deletion, defect, failure, malfunction, alteration, delay in delivery, operation or transmission, or other circumstance of any kind, which may affect any person’s entry or participation in the competition.

17. This competition is not open to any employees or contractors (or their immediate family members) of the EMA or nib or its related companies however they may complete the survey.

18. Entering the competition is deemed acceptance of these terms & conditions.

19. Entrants agree that by entering the draw any personal information we collect will be held and used in accordance with nib and EMA’s privacy policy (as applicable). You can find nib’s privacy policy here and EMA’s here. By entering the competition, you agree EMA and nib are permitted to access and use your details to contact you for the purposes of administering the competition (including providing you with the survey results), in relation to a prize or for further promotional and media publicity purposes, including on the nib or EMA official websites or social media pages including but not limited to LinkedIn pages, without compensation and without seeking further approval. If you are a winner, you consent to your name and other details provided by you being publicly disclosed but we will not publish email, address or phone details provided. Entrants also consent to receiving commercial electronic messages from nib and the EMA. Entrants may unsubscribe at any time to receiving such messages by following the unsubscribe process specified in any such electronic message that they receive.

20. This competition is promoted by the Employers and Manufacturers Association (Northern) Limited (EMA) 145 Khyber Pass Road, Grafton, Auckland 1023 and nib nz limited, 48 Shortland Street, Auckland (nib).

21. You must consent to the terms, conditions and waiver of Awareness Academy and The Sauna Collective set out below.

Mobile Sauna & ICE bath Station Waiver Form Sauna Collective Ltd, Auckland, New Zealand

I, hereby acknowledge and agree to the terms and conditions outlined in this mobile sauna and Use Waiver Form (“Waiver”). I understand and accept the inherent risks associated with using the Sauna Collectives Mobile Sauna & Ice Bath Station, New Zealand. By signing this Waiver, I voluntarily assume these risks and release Sauna Collectives from any liability or claims that may arise during or as a result of my participation.

Assumption of Risk:

I understand and acknowledge the following:

1. Inherent Risks: The use of Sauna Collectives Mobile Sauna & ICE Bath Station may involve exposure to heat, steam, & cold, which in an unlikely event, can pose certain health risks, including but not limited to dehydration, overheating, cooling, and other physical discomforts.

2. Health and Fitness: I am responsible for evaluating my own health and fitness level before using the facilities. I affirm that I am in good health and have no medical conditions that would preclude me from safely using the sauna.

3. Supervision: I understand that Sauna Collective may provide general guidelines for sauna usage, but I am solely responsible for monitoring and regulating my own sauna experience.

Waiver and Release of Liability for The Sauna Collective and The Awareness Academy:

In consideration for being allowed to use the Sauna Collectives Mobile Sauna & ICE bath Station and/or The Awareness Academy, I hereby release and discharge Sauna Collective and The Awareness Academy, their employees, agents, and representatives, from any and all claims, demands, actions, or causes of action, whether in law or in equity, arising out of any injuries, damages, or losses that may occur as a result of my use of the facilities.

Indemnification:

I agree to indemnify and hold harmless Sauna Collective and The Awareness Academy from all claims, demands, actions, or causes of action brought by third parties as a result of my use of the sauna facilities.

Emergency Medical Care:

In the unlikely event of a medical emergency, I authorize Sauna Collective and The Awareness Academy to seek medical treatment on my behalf and release them from any liability in doing so.

Photography and Media:
I grant Sauna Collectives and The Awareness Academy the right to take photographs and videos of me while using their facilities and agree that they may use such media for promotional purposes without further consent or payment.
